The term \u201chotel accommodation contract\u201d includes and replaces the following terms: accommodation contract, guest accommodation contract, hotel contract, hotel room contract. <\/li>\n<li>The subletting or re-letting of the rooms provided and their use for purposes other than accommodation require the prior consent of the hotel in text form, whereby \u00a7 540 paragraph 1 sentence 2 BGB is waived insofar as the customer is not a consumer within the meaning of \u00a7 13 BGB.<\/li>\n<li>The customer&#8217;s general terms and conditions shall only apply if this has been expressly agreed in advance in text form.<\/li>\n<\/ol>\n<\/div><\/section>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-i3n0-b574e9acf1291ebb8f67569ef22364ac\">\n#top .av-special-heading.av-i3n0-b574e9acf1291ebb8f67569ef22364ac{\npadding-bottom:0;\n}\nbody .av-special-heading.av-i3n0-b574e9acf1291ebb8f67569ef22364ac .av-special-heading-tag .heading-char{\nfont-size:25px;\n}\n.av-special-heading.av-i3n0-b574e9acf1291ebb8f67569ef22364ac .av-subheading{\nfont-size:15px;\n}\n<\/style>\n<div  class='av-special-heading av-i3n0-b574e9acf1291ebb8f67569ef22364ac av-special-heading-h3 blockquote modern-quote  avia-builder-el-7  el_after_av_textblock  el_before_av_hr '><h3 class='av-special-heading-tag '  itemprop=\"headline\"  >2. The contract is concluded upon acceptance of the customer&#8217;s application by the hotel. The hotel is at liberty to confirm the room booking in text form.  <\/li>\n<li>All claims against the hotel are generally subject to a limitation period of one year from the commencement of the statutory limitation period. This does not apply to claims for damages and other claims, insofar as the latter are based on an intentional or grossly negligent breach of duty by the hotel. <\/li>\n<\/ol>\n<\/div><\/section>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-4j5v0-f598c75c04f06b2a54af0afe9efc2eff\">\n#top .av-special-heading.av-4j5v0-f598c75c04f06b2a54af0afe9efc2eff{\npadding-bottom:0;\n}\nbody .av-special-heading.av-4j5v0-f598c75c04f06b2a54af0afe9efc2eff .av-special-heading-tag .heading-char{\nfont-size:25px;\n}\n.av-special-heading.av-4j5v0-f598c75c04f06b2a54af0afe9efc2eff .av-subheading{\nfont-size:15px;\n}\n<\/style>\n<div  class='av-special-heading av-4j5v0-f598c75c04f06b2a54af0afe9efc2eff av-special-heading-h3 blockquote modern-quote  avia-builder-el-10  el_after_av_textblock  el_before_av_hr '><h3 class='av-special-heading-tag '  itemprop=\"headline\"  >3. SERVICES, PRICES, PAYMENT, OFFSETTING<\/h3><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-camic-5c85356dba4d8d93148f95bbece0c044\">\n#top .hr.hr-invisible.av-camic-5c85356dba4d8d93148f95bbece0c044{\nheight:10px;\n}\n<\/style>\n<div  class='hr av-camic-5c85356dba4d8d93148f95bbece0c044 hr-invisible  avia-builder-el-11  el_after_av_heading  el_before_av_textblock '><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div>\n<section  class='av_textblock_section av-bw3a8-092e0944e928c995789251860c065389 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><ol>\n<li>The hotel is obliged to keep the rooms booked by the customer available and to provide the agreed services.<\/li>\n<li>The customer is obliged to pay the agreed or applicable prices of the hotel for the room rental and the other services used by him. This also applies to services commissioned by the customer directly or via the hotel, which are provided by third parties and disbursed by the hotel. <\/li>\n<li>The agreed prices include the taxes and local charges applicable at the time the contract is concluded. Not included are local taxes which are owed by the guest according to the respective municipal law, such as visitor&#8217;s tax. In the event of a change in the statutory value added tax or the introduction, change or abolition of local levies on the subject matter of the service after conclusion of the contract, the prices shall be adjusted accordingly. In the case of contracts with consumers, this only applies if the period between conclusion and fulfillment of the contract exceeds four months.   <\/li>\n<li>Breakfast is always included in the agreed price and is provided as an additional service to the main service. It can neither be booked as an optional extra nor deselected. <\/li>\n<li>The hotel may make its consent to a subsequent reduction in the number of rooms booked, the hotel&#8217;s services or the length of the customer&#8217;s stay requested by the customer dependent on a reasonable increase in the price for the rooms and\/or for the hotel&#8217;s other services.<\/li>\n<li>Hotel invoices are due for payment without deduction immediately upon receipt. If payment on account has been agreed, payment must be made without deduction within ten days of receipt of the invoice, unless otherwise agreed. <\/li>\n<li>The hotel is entitled to demand a reasonable advance payment or security deposit from the customer upon conclusion of the contract, for example in the form of a credit card guarantee. The amount of the advance payment and the payment dates may be agreed in text form in the contract. In the case of advance payments or security deposits for package tours, the statutory provisions remain unaffected. If the customer is in default of payment, the statutory provisions shall apply.   <\/li>\n<li>In justified cases, for example if the customer is in arrears with payment or if the scope of the contract is extended, the hotel is entitled, even after conclusion of the contract up to the start of the stay, to demand an advance payment or security deposit within the meaning of Section 3.6 above or an increase in the advance payment or security deposit agreed in the contract up to the full agreed remuneration.<\/li>\n<li>Furthermore, the hotel is entitled to demand a reasonable advance payment or security deposit from the customer at the beginning and during the stay within the meaning of Section 3.6 above for existing and future claims arising from the contract, insofar as such a payment has not already been made in accordance with Section 3.6 and\/or Section 3.7 above.<\/li>\n<li>The customer may only offset or set off an undisputed or legally binding claim against a claim of the hotel.<\/li>\n<li>The customer agrees that the invoice may be sent to him electronically.<\/li>\n<\/ol>\n<\/div><\/section>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-3c4sc-654d2d2c19c53ae60440fd8f221bdecd\">\n#top .av-special-heading.av-3c4sc-654d2d2c19c53ae60440fd8f221bdecd{\npadding-bottom:0;\n}\nbody .av-special-heading.av-3c4sc-654d2d2c19c53ae60440fd8f221bdecd .av-special-heading-tag .heading-char{\nfont-size:25px;\n}\n.av-special-heading.av-3c4sc-654d2d2c19c53ae60440fd8f221bdecd .av-subheading{\nfont-size:15px;\n}\n<\/style>\n<div  class='av-special-heading av-3c4sc-654d2d2c19c53ae60440fd8f221bdecd av-special-heading-h3 blockquote modern-quote  avia-builder-el-13  el_after_av_textblock  el_before_av_hr '><h3 class='av-special-heading-tag '  itemprop=\"headline\"  >4. WITHDRAWAL BY THE CUSTOMER (CANCELATION, CANCELLATION)\/ NON-UTILIZATION OF THE HOTEL\u2019S SERVICES (NO SHOW)<\/h3><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-8xfbc-3470b897a81dd10369329e7013606f72\">\n#top .hr.hr-invisible.av-8xfbc-3470b897a81dd10369329e7013606f72{\nheight:10px;\n}\n<\/style>\n<div  class='hr av-8xfbc-3470b897a81dd10369329e7013606f72 hr-invisible  avia-builder-el-14  el_after_av_heading  el_before_av_textblock '><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div>\n<section  class='av_textblock_section av-8753g-0458db1ade282da3229bb55bda569fa9 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><ol>\n<li>The customer may only withdraw from the contract concluded with the hotel if a right of withdrawal has been expressly agreed in the contract, a statutory right of withdrawal exists or if the hotel expressly agrees to the cancellation of the contract.<\/li>\n<li>If the hotel and the customer have agreed on a date for a cost-free withdrawal from the contract, the customer may withdraw from the contract up to that date without incurring payment or damage compensation claims by the hotel.<\/li>\n<li>If a right of withdrawal has not been agreed or has already expired, there is also no statutory right of withdrawal or termination and if the hotel does not agree to a termination of the contract, the hotel shall retain the claim to the agreed remuneration despite non-utilization of the service. The hotel must offset the income from renting the rooms to other parties as well as the expenses saved. If the rooms are not rented to other parties, the hotel may make a lump-sum deduction for saved expenses. In this case, the customer is obliged to pay 90% of the contractually agreed price for overnight accommodation with or without breakfast and for package arrangements with third-party services, 70% for half-board and 60% for full-board arrangements. The customer is free to prove that the aforementioned claim did not arise or did not arise in the amount claimed.    <\/li>\n<li>\n<p class=\"x_MsoListParagraph\"><span data-olk-copy-source=\"MessageBody\">When booking the &#8220;Park, Sleep &amp; Fly&#8221; package, the guest expressly agrees and acknowledges that the deposit of the vehicle key is mandatory for the entire duration of the parking service. This is exclusively for organizational and manoeuvring purposes on or between our parking spaces. Refusal to hand over the vehicle key constitutes a deficiency in the provision of the service on the part of the guest.    <\/span>Cancellation of the &#8220;Park, Sleep &amp; Fly&#8221; package after expiry of the regular cancellation period stated in the booking confirmation on the grounds that the guest does not wish to hand over the key is excluded. In this case, the guest&#8217;s obligation to pay the full cost of the booked stay and the parking service remains unaffected. <\/p>\n<\/li>\n<\/ol>\n<\/div><\/section>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-2nsh4-3bc418f99f682849a6bb0d064bc34f73\">\n#top .av-special-heading.av-2nsh4-3bc418f99f682849a6bb0d064bc34f73{\npadding-bottom:0;\n}\nbody .av-special-heading.av-2nsh4-3bc418f99f682849a6bb0d064bc34f73 .av-special-heading-tag .heading-char{\nfont-size:25px;\n}\n.av-special-heading.av-2nsh4-3bc418f99f682849a6bb0d064bc34f73 .av-subheading{\nfont-size:15px;\n}\n<\/style>\n<div  class='av-special-heading av-2nsh4-3bc418f99f682849a6bb0d064bc34f73 av-special-heading-h3 blockquote modern-quote  avia-builder-el-16  el_after_av_textblock  el_before_av_hr '><h3 class='av-special-heading-tag '  itemprop=\"headline\"  >5. WITHDRAWAL OF THE HOTEL<\/h3><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-6qk48-ac7db40b8bc40efe54abe9d49b994482\">\n#top .hr.hr-invisible.av-6qk48-ac7db40b8bc40efe54abe9d49b994482{\nheight:10px;\n}\n<\/style>\n<div  class='hr av-6qk48-ac7db40b8bc40efe54abe9d49b994482 hr-invisible  avia-builder-el-17  el_after_av_heading  el_before_av_textblock '><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div>\n<section  class='av_textblock_section av-6gqc4-b470a4781d8813c397cc4f4196b1c33f '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><ol>\n<li>If it has been agreed that the customer can withdraw from the contract free of charge within a certain period of time, the hotel is entitled to withdraw from the contract during this period if there are inquiries from other customers for the contractually booked rooms and the customer does not waive his right of withdrawal upon inquiry by the hotel within a reasonable period of time. This shall apply accordingly if an option is granted, if other inquiries are received and the customer is not prepared to make a firm booking when asked by the hotel within a reasonable period of time. <\/li>\n<li>If an advance payment or security deposit agreed or demanded in accordance with Section 3.6 and\/or Section 3.7 is not made even after a reasonable grace period set by the hotel has expired, the hotel shall also be entitled to withdraw from the contract.<\/li>\n<li>Furthermore, the hotel is entitled to withdraw from the contract extraordinarily for objectively justified reasons, in particular if<br \/>\n&#8211; force majeure or other circumstances for which the hotel is not responsible make it impossible to fulfill the contract;<br \/>\n&#8211; rooms or rooms are culpably booked with misleading or false information or concealment of material facts; material facts may include the identity of the customer, the ability to pay or the purpose of the stay;<br \/>\n&#8211; the hotel has justified cause to believe that the use of the service may jeopardize the smooth operation, security or public reputation of the hotel, without this being attributable to the hotel&#8217;s sphere of control or organization;<br \/>\n&#8211; the purpose or reason for the stay is unlawful;<br \/>\n&#8211; there is a breach of section 1.2 above.<\/li>\n<li>The justified withdrawal of the hotel does not constitute a claim for damages on the part of the customer.<\/li>\n<\/ol>\n<\/div><\/section>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-1xw58-2ccd0382efa9db7848136748bcd0e4b5\">\n#top .av-special-heading.av-1xw58-2ccd0382efa9db7848136748bcd0e4b5{\npadding-bottom:0;\n}\nbody .av-special-heading.av-1xw58-2ccd0382efa9db7848136748bcd0e4b5 .av-special-heading-tag .heading-char{\nfont-size:25px;\n}\n.av-special-heading.av-1xw58-2ccd0382efa9db7848136748bcd0e4b5 .av-subheading{\nfont-size:15px;\n}\n<\/style>\n<div  class='av-special-heading av-1xw58-2ccd0382efa9db7848136748bcd0e4b5 av-special-heading-h3 blockquote modern-quote  avia-builder-el-19  el_after_av_textblock  el_before_av_hr '><h3 class='av-special-heading-tag '  itemprop=\"headline\"  >6. ROOM PROVISION, HANDOVER AND RETURN<\/h3><div class=\"special-heading-border\"><div class=\"special-heading-inner-border\"><\/div><\/div><\/div>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-51y68-9b68535ce027ca917489c9a3fb59e5e0\">\n#top .hr.hr-invisible.av-51y68-9b68535ce027ca917489c9a3fb59e5e0{\nheight:10px;\n}\n<\/style>\n<div  class='hr av-51y68-9b68535ce027ca917489c9a3fb59e5e0 hr-invisible  avia-builder-el-20  el_after_av_heading  el_before_av_textblock '><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div>\n<section  class='av_textblock_section av-4mh5g-4e6298c71f8ecab20bcf6782e4c6f878 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><ol>\n<li>The customer shall not acquire any entitlement to the provision of specific rooms unless this has been expressly agreed in text form.<\/li>\n<li>Booked rooms are <strong>available to<\/strong> the customer <strong>from 15:00<\/strong> on the agreed day of arrival. The customer is not entitled to earlier availability.   <span data-olk-copy-source=\"MessageBody\">Check-in is possible on the day of arrival until 22:00 at the latest. Arrival <strong>after 10:00 p.m.<\/strong> requires the prior written consent of the hotel. This consent must be expressly and verifiably given to the guest. If check-in does not take place by 10:00 p.m. and there is no written confirmation of a later arrival by the hotel, the reservation is deemed not to have been used (\u201cno show\u201d). In this case, the hotel reserves the right to allocate the reserved room to someone else. The guest loses his right to the provision of the room. In the event of a no-show, the agreed accommodation price as per the booking confirmation is due in full. There is no entitlement to a refund unless the hotel has actually generated other revenue from re-letting the room.       <\/span><\/li>\n<li>On the agreed day of departure, the rooms must <strong>be vacated and<\/strong> made available to the hotel by <strong>11:00 a.m.<\/strong> at the latest. Thereafter, the hotel may charge 50% of the full accommodation price (price according to the price list) for the delayed vacating of the room until 6:00 p.m., and 90% from 6:00 p.m. onwards. This shall not give rise to any contractual claims on the part of the customer. Furthermore, it is liable for other damages which are based on an intentional or grossly negligent breach of duty by the hotel or on an intentional or negligent breach of typical contractual obligations by the hotel. Typical contractual obligations are those obligations which make the proper execution of the contract possible in the first place and on the fulfillment of which the customer relies and may rely. A breach of duty by a legal representative or vicarious agent is equivalent to a breach of duty by the hotel. Further claims for damages are excluded, unless otherwise regulated in this clause 7. Should disruptions or defects in the hotel&#8217;s services occur, the hotel shall endeavor to remedy such upon knowledge thereof or upon immediate complaint by the customer. The customer is obliged to do what can reasonably be expected of him in order to remedy the disruption and minimize any possible damage.      <\/li>\n<li>The hotel is liable to the customer for items brought into the hotel in accordance with the statutory provisions. The hotel recommends the use of the hotel or room safe. If the customer wishes to bring in money, securities and valuables with a value of more than 800 euros or other items with a value of more than 3,500 euros, this requires a separate storage agreement with the hotel.  <\/li>\n<li>Insofar as the customer is provided with a parking space in the hotel garage or on the hotel parking lot, even for a fee, this does not constitute a safekeeping agreement. In the event of loss of or damage to motor vehicles parked or maneuvered on the hotel property and their contents, the hotel shall only be liable in accordance with the above clause 7.1, sentences 1 to 4. <\/li>\n<li>Wake-up calls are carried out by the hotel with the utmost care. Messages for customers are handled with care. After prior consultation with the customer, the hotel may accept, store and &#8211; upon request &#8211; forward mail and merchandise for a fee.
